Avive la Vie INC Terms & Conditions
Last Updated: August 19, 2025
Welcome to Avivelavie.com (the “Site”), operated by Avive la Vie INC (“Avive la Vie,” “we,” “us,” or “our”). These Terms & Conditions (the “Terms”) govern your access to and use of the Site, our online courses, cohorts, memberships, events, and related materials and communities (collectively, the “Services”).
By using the Site or purchasing/attending the Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
1) Who We Are / What We Offer
Avive la Vie provides professional development and training in Experiential Engagement Therapy (EET)—including a multi-cycle certification pathway, live labs, intensives (in-person or online), practice pods, supervision-style skills coaching, and a private Kajabi community.
We are not a healthcare provider and do not provide therapy, medical, legal, or licensure services.
2) Eligibility
You must be 18 or older to use the Site or purchase Services. Where Services are marketed to therapists/coaches, you represent that you will participate only within your lawful professional scope and that you will follow all applicable laws, ethical codes, and licensing rules in your jurisdiction.
3) Accounts; Access; Security
Some features require an account (e.g., Kajabi, Zoom). You are responsible for the security of your logins and for all activity under your accounts. Notify us immediately of unauthorized access.
4) Professional Development Only (No Therapy / No Licensure)
All content is educational. Participation does not create a therapist–client relationship with Avive la Vie or its facilitators, does not confer licensure or board certification, and does not substitute for clinical supervision, emergency services, or medical/psychological treatment. You are solely responsible for your professional decisions and client care.
5) Community Standards; Confidentiality; No PHI
Our cohort and community spaces (e.g., Kajabi) are built on psychological safety and professional ethics.
- Be kind, specific, and behavioral in feedback. No harassment, discrimination, or solicitation of peers’ clients.
- Confidentiality: You must anonymize all client information and never post Protected Health Information (PHI) or identifying details.
- You agree to keep all cohort discussions and participant-shared materials confidential unless you have explicit written permission to share.
We may suspend or remove anyone who violates these standards.
6) Recordings; Consent; Privacy
Live labs, supervision, intensives, and some community events may be recorded for educational use within your cohort and for improving our training materials. By attending, you consent to being recorded. If you need to avoid being captured during a sensitive segment, notify the facilitator in real time; we will accommodate when feasible.
We use third-party platforms (e.g., Kajabi, Zoom, AddEvent, payment processors). Their use is subject to their respective terms and privacy policies. See our Privacy Policy for how we handle data.
7) Intellectual Property; License to You; Your Submissions
All Site/Service content—including curricula, videos, handouts, formats, names, logos, graphics, and methods (collectively, “Content”)—is owned by Avive la Vie or our licensors and is protected by IP laws.
- We grant you a limited, revocable, non-transferable license to access and use the Content for your own professional practice with clients.
- You may not copy, publish, resell, re-post, sublicense, or create derivative trainings based on our Content without prior written permission.
- You may not use our Content to train AI or automated systems without written permission.
- If you provide comments, suggestions, or materials (“Feedback” or “User Content”), you grant us a worldwide, royalty-free license to use that material for educational and operational purposes, subject to confidentiality terms above.
8) Purchases; Pricing; Taxes
Prices are shown at checkout and may vary by cohort or promotion. You authorize us (and our processors) to charge your selected payment method for the amounts due, plus applicable taxes/VAT. If a payment fails, we may suspend access until resolved.
Some Services are subscriptions (e.g., memberships). Unless otherwise stated, subscriptions auto-renew and can be canceled per the instructions in your account or by contacting support.
9) Refunds; Deferrals; Cancellations (Core Policies)
Unless explicitly modified on a specific checkout page, the following apply:
EET Certification (per 90-day cycle)
- Fit Guarantee: Attend the first two live labs, join one pod, and try one micro-move in session. If it’s not a fit, email [Support Email] within 48 hours after Lab 2 for a full refund.
- Deferral: You may request one free deferral to any cohort within 12 months at the same price you paid (including Early Bird) if requested before Week 5 of the cycle.
- No-shows / late cancellations outside these windows are generally not refundable.
Memberships
- Month-to-month; cancel anytime effective at the end of the current billing period. Unless otherwise stated, membership fees are non-refundable once a period starts.
In-Person Events / Intensives
- Tuition covers training; travel/lodging are your responsibility. We may move an in-person event online for safety, venue, or force-majeure reasons. If we materially change dates and you cannot attend, we’ll offer a transfer/deferral.
Any alternate or program-specific terms displayed at checkout control over this section.
10) Changes to Services and Terms
We may update the Site, Content, schedules, or these Terms at any time. Material changes will be posted with a new “Last Updated” date. Your continued use after changes means you accept the updated Terms.
11) Acceptable Use
You agree not to:
- Violate laws or others’ rights; upload malware; attempt to access others’ accounts; interfere with security or operations.
- Scrape, spider, or harvest Content or personal data.
- Misrepresent your identity, credentials, or affiliation.
- Use the Services to provide therapy, emergency care, or unlicensed services.
12) Disclaimers
The Site and Services are provided “as is” and “as available.” We disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee outcomes (e.g., certification, CE acceptance, client results).
13) Limitation of Liability
To the maximum extent permitted by law, Avive la Vie and its owners, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption.
Our total liability for any claim arising out of or relating to the Site or Services is limited to the amount you paid to us for the specific Service during the 12 months before the claim arose.
Some jurisdictions do not allow certain limitations; where prohibited, this Section applies only to the extent permitted.
14) Indemnification
You will defend, indemnify, and hold harmless Avive la Vie from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site/Services; (b) your professional activities or client interactions; (c) your violation of these Terms; or (d) your infringement/misuse of IP or confidential information.
15) Governing Law; Venue; Dispute Resolution (Oregon)
These Terms are governed by the laws of the State of Oregon, USA, without regard to conflicts principles.
- Good-Faith Resolution: We’ll first attempt to resolve disputes by good-faith discussion within 30 days.
- Mediation: If unresolved, the parties will submit the dispute to mediation in Oregon before filing suit.
- Venue: If court action is necessary, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Oregon. Small-claims matters may proceed directly in small-claims court.
- Injunctive Relief: We may seek injunctive relief for IP/confidentiality breaches.
