These Terms of Use ("Terms") govern your access to and use of our websites, books, podcasts, newsletters, workshops, memberships, facilitator certification programs, online courses, events, communities, and related services (collectively, the "Services").

By using our Site or participating in any of our Services, you agree to these Terms. If you do not agree, please do not use our Site or Services.

1. Who We Are

Avive la Vie provides educational experiences designed to help individuals develop greater emotional awareness, authentic connection, belonging, and personal growth.

Our educational approach may include the teachings and methods developed by JF Benoist, including concepts such as the Monkey Mind, Belonging, the Three Doors, Experiential Engagement Therapy (EET), and related intellectual property.

2. Educational Purposes Only

All Services are provided for educational and personal or professional development purposes.

Our Services are not intended to diagnose, treat, cure, or prevent any medical or mental health condition.

Participation does not establish a therapist-client, counselor-client, physician-patient, attorney-client, or other professional relationship.

You remain solely responsible for your own decisions, actions, and wellbeing.

3. Eligibility

You must be at least 18 years old to use our Services unless a parent or legal guardian provides permission where legally permitted.

By using our Services, you represent that you have the legal capacity to enter into this agreement.

4. Accounts and Security

Some Services require creating an account through platforms such as Kajabi, Zoom, or other third-party providers.

You are responsible for:

maintaining your password security,
keeping your account information current,
all activity occurring under your account.

Please notify us immediately if you believe your account has been compromised.

5. Community Standards

We strive to create communities built upon kindness, curiosity, respect, and authentic connection.

By participating in our communities, you agree to:

treat others respectfully,
avoid harassment or discrimination,
refrain from abusive or disruptive behavior,
avoid unsolicited promotion or spam,
respect the privacy of other members.

We reserve the right to remove content or suspend access for violations of these standards.

6. Confidentiality

Many of our workshops, Pods, memberships, and facilitator trainings involve personal sharing.

While we cannot guarantee that other participants will maintain confidentiality, we ask every participant to respect the privacy of others.

Do not share another participant's personal information without their permission.

For professional participants, you are responsible for complying with all applicable confidentiality, privacy, and professional standards in your own practice.

7. Recordings

Some workshops, memberships, certification sessions, or community events may be recorded.

By participating, you consent to the recording and educational use of those recordings within Avive la Vie unless otherwise stated.

If you prefer not to appear during a particular session, please notify the facilitator beforehand whenever possible.

8. Intellectual Property

All content provided by Avive la Vie remains the exclusive property of Avive la Vie INC unless otherwise indicated.

This includes, but is not limited to:

presentations
graphics

exercises
recordings
course materials
written content
logos
trademarks

You may use our materials for your own personal learning and, where applicable, within the permissions granted through a Facilitator Certification.

You may not:

copy,
reproduce,
distribute,
resell,
sublicense,
create competing training programs,
upload our materials to AI systems for training,
or otherwise use our intellectual property without prior written permission.

9. User Content

If you submit comments, testimonials, reviews, questions, suggestions, or other content, you grant Avive la Vie a non-exclusive, worldwide, royalty-free license to use that content for educational, operational, or promotional purposes unless you specifically request otherwise.

10. Purchases

Prices are shown at checkout.

By purchasing a Service, you authorize us and our payment processors to charge your selected payment method.

Applicable taxes may be added where required by law.

Failure of payment may result in suspension of access until payment is resolved.

11. Memberships

Certain Services operate as recurring memberships.

These may include:

other subscription-based Services

Unless otherwise stated:

memberships automatically renew,
you may cancel according to the instructions provided within your account,
cancellations take effect at the end of the current billing period,
fees already paid are generally non-refundable unless otherwise stated at checkout.

12. Workshops and Events

We offer both online and in-person workshops.

Schedules, presenters, locations, and formats may occasionally change.

If an in-person event must be moved online because of circumstances beyond our control, your registration will remain valid unless otherwise specified.

Any event-specific policies displayed during registration take precedence over this section.

13. Facilitator Certification

Certain Services include professional Facilitator Certification.

Certification programs may include additional requirements regarding:

attendance,
participation,
practice groups,
assessments,
recordings,
intellectual property,
certification standards,
continuing participation,
refund or deferral policies.

Those additional program terms become part of these Terms and take precedence whenever they differ.

Completion of a certification program does not constitute government licensure or legal authorization to practice any regulated profession.

14. Newsletter Communications

By subscribing to our newsletter, you agree to receive communications relating to:

You may unsubscribe at any time using the link provided in our emails.

15. Acceptable Use

You agree not to:

violate applicable laws,
interfere with our systems,

infringe our intellectual property rights.

18. Limitation of Liability

To the fullest extent permitted by law, Avive la Vie INC, its owners, employees, contractors, facilitators, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Our total liability for any claim shall not exceed the amount you paid us for the specific Service giving rise to the claim during the previous twelve months.

19. Indemnification

You agree to indemnify and hold harmless Avive la Vie INC from claims arising from:

your use of the Services,
your violation of these Terms,
your misuse of our intellectual property,
your violation of another person's rights.

20. Governing Law

These Terms are governed by the laws of the State of Oregon, USA.

The parties agree to first attempt good-faith resolution of disputes.

If necessary, disputes shall be resolved in the courts located in Oregon.

Nothing prevents either party from seeking injunctive relief for intellectual property or confidentiality violations.

21. Changes to These Terms

We may update these Terms periodically.

Changes become effective upon posting the updated version with a revised "Last Updated" date.

Continued use of our Services constitutes acceptance of the revised Terms.
